Please read this disclaimer before using KIWAMU. It forms part of the Terms of Use. By downloading or using KIWAMU you confirm that you have read and accept it.
1. For training and enjoyment only
KIWAMU offers short exercises for memory, logic, spatial thinking, math, focus and flexibility. All content in the app and on this website is provided for general training, practice and enjoyment purposes only.
2. Not medical, psychological or professional advice
KIWAMU is not a medical device and is not a medical, psychological, diagnostic, therapeutic or educational assessment tool. It does not diagnose, treat, cure, prevent or monitor any disease, disorder or condition, including any condition affecting memory, attention, learning or mood.
Nothing in KIWAMU replaces the advice of a doctor or other qualified professional. If you have any concern about your memory, concentration or health, consult a qualified professional. Never delay or disregard professional advice because of anything you have seen in KIWAMU.
3. KQ is not an IQ test
KQ (the KIWAMU Quotient), scores, levels, streaks, badges and other results are estimates calculated only from your play in KIWAMU's own exercises. They are shown for motivation and progress tracking. They are not an IQ score, a clinical or scientific measure of intelligence or ability, and must not be used for any medical, educational, employment, legal or other official decision.
4. No guaranteed results
Results differ from person to person. Memorvix makes no promise or guarantee that using KIWAMU will improve your memory, intelligence, focus, performance at school or work, or any other ability in daily life. Any improvement you see in KIWAMU's scores reflects how you play KIWAMU's exercises.
5. Health and safety
- Light sensitivity. KIWAMU uses colours, motion and changing images. A very small number of people may experience seizures or other symptoms when exposed to such content. If you or your family have a history of epilepsy or seizures, consult a doctor before using KIWAMU.
- Stop if you feel unwell. Stop using KIWAMU straight away and seek medical advice if you experience dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, headache, or any other discomfort.
- Take breaks. Use KIWAMU in a well-lit room and take regular breaks to rest your eyes and hands.
- Stay safe. Never use KIWAMU while driving, walking in traffic, operating machinery, or in any situation that needs your full attention.
6. Intended for adults
KIWAMU is intended for people aged 18 and over and is not designed for children.
7. Provided "as is"
KIWAMU and this website are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Memorvix gives no warranties of any kind, express or implied, including about accuracy, reliability, availability, fitness for a particular purpose or freedom from errors. Your use of KIWAMU is at your own risk and discretion.
8. Advertising and third-party content
Free use of KIWAMU is supported by ads served by Google AdMob. Ads are selected and provided by third parties, not by Memorvix. Memorvix does not endorse, and is not responsible for, any advertised product, service, website or claim. Any dealings you have with an advertiser are solely between you and that advertiser.
9. Third-party services
KIWAMU relies on services provided by others, including Google Play (downloads, subscriptions and payments), Google AdMob (ads) and Google Firebase (analytics, crash reports and notifications). Their availability and conduct are outside Memorvix's control, and your use of them is also governed by their own terms and privacy policies. How KIWAMU handles data is explained in the Privacy Policy.
10. Subscriptions and prices
Prices, free trials and offers for KIWAMU Master are shown and charged by Google Play in your local currency and may vary by country, include local taxes and change over time. Billing, cancellation and refunds are handled by Google Play under its own policies. Offers shown in the app are available for a limited time, may change or end at any time, and do not create any obligation outside Google Play's purchase terms.
11. Limitation of liability
To the fullest extent permitted by law, Memorvix and its owners shall not be liable for any direct, indirect, incidental, special or consequential loss or damage, including injury, loss of data, progress, profits or opportunity, arising from or related to your use of, or inability to use, KIWAMU or this website, or reliance on any score or content in them. Where liability cannot be excluded, it is limited to the amount you paid Memorvix for KIWAMU in the 12 months before the claim. Nothing in this disclaimer limits rights you have under consumer protection law that cannot be limited or excluded.
12. Your responsibility
You agree to use KIWAMU lawfully and in line with this disclaimer and the Terms of Use, and you are responsible for deciding whether KIWAMU is suitable for you.
13. Trademarks
KIWAMU and Memorvix are trademarks of Memorvix. Google Play, AdMob and Firebase are trademarks of Google LLC. The use of third-party names does not imply any endorsement.
14. Changes
Memorvix may update this disclaimer at any time. The effective date above will change, and continuing to use KIWAMU after an update means you accept the updated disclaimer.
15. Law
This disclaimer is governed by the laws of the United Arab Emirates, without affecting any mandatory consumer protection you have where you live.
